Terms of Service

These terms explain the rules for using Desert Drama Match 3 and making optional in-game purchases.

Effective: September 15, 2026

1. Agreement to these terms

These Terms of Service (the Terms) are an agreement between you and East Valley Software, LLC (we, us, or our) governing your download, access to, and use of Desert Drama Match 3, including its content and services (collectively, the Game). By accepting these Terms or using the Game, you agree to them and to our Privacy Policy. If you do not agree, do not use the Game.

2. Eligibility and minors

You must be at least 13 years old to use the Game. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms and supervise your use of the Game. You represent that you meet these requirements.

A minor may make a purchase only with permission from the person responsible for the Google Play account and payment method. Parents and guardians are responsible for configuring device and Google Play purchase controls appropriate for their household.

3. License to use the Game

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the Game for noncommercial entertainment on a compatible device you own or control. The Game is licensed, not sold. We and our licensors retain all rights not expressly granted.

4. Acceptable use

You may not:

  • use the Game for unlawful, fraudulent, or abusive purposes;
  • copy, distribute, sell, rent, sublicense, or commercially exploit the Game except as applicable law expressly permits;
  • reverse engineer, modify, bypass, or interfere with the Game, purchase validation, security features, or technical restrictions, except where applicable law does not allow that restriction;
  • use cheats, automation, exploits, or unauthorized third-party tools to alter gameplay, progress, virtual items, or purchases; or
  • introduce malware, overload systems, or infringe another person's intellectual-property, privacy, or other rights.

5. In-app purchases

The Game may offer optional in-app purchases of digital content or benefits. In-app purchases have no cash value, are not legal tender, do not earn interest, and cannot be redeemed for money, transferred, traded, or used outside the Game. You receive a limited license to use purchased content within the Game; you do not acquire an ownership interest in it.

Purchases are optional and are processed through Google Play. The Game will show the product, contents or benefit, price, and whether it is consumable, non-consumable, or recurring before purchase. Taxes and currency conversion may apply. Google Play's terms govern payment processing. The Game does not offer loot boxes or real-money prizes.

Please check the product and price before confirming. Except where required by law or Google Play policy, completed and used in-app purchases are final and non-refundable. Refund requests are handled under Google Play's refund process and applicable law. If a purchase is refunded, reversed, charged back, or otherwise invalidated, we may remove the related content or benefits, including resulting negative balances where reasonably necessary to correct the reversal.

If you believe a purchase was not delivered correctly, contact help@eastvalleysoftware.com with non-sensitive transaction details. Do not email your full payment-card number or password.

6. Game progress and availability

Game progress and purchase-fulfillment records are stored locally and are not tied to a player account or cloud-save service. Clearing app data, uninstalling the Game, losing access to a device, or certain device failures may permanently remove progress and locally stored purchased content.

We may update, rebalance, add, remove, suspend, or discontinue Game features when reasonably necessary for operation, security, legal compliance, or product development. We will respect non-waivable consumer rights and will not intentionally remove purchased content in a manner prohibited by applicable law.

7. Ownership

The Game—including its software, artwork, characters, animation, music, sound, text, designs, trademarks, and other content—is owned by East Valley Software, LLC or its licensors and is protected by applicable intellectual-property laws. East Valley Software, Desert Drama, and related names, logos, and designs may not be used without prior written permission, except as law permits.

8. Third-party services

The Game relies on services supplied by third parties, including Google Play and Firebase. Your use of those services may be subject to their separate terms and policies. We are not responsible for a third-party service except to the extent required by applicable law.

9. Disclaimers

To the fullest extent permitted by law, the Game is provided as is and as available. We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not guarantee that the Game will always be uninterrupted, error-free, secure, compatible with every device, or that progress will never be lost. Some jurisdictions do not allow certain warranty exclusions, so these exclusions may not fully apply to you.

10. Limitation of liability

To the fullest extent permitted by law, East Valley Software, LLC and its owners, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost data, profits, goodwill, or business interruption arising from the Game. The total liability of East Valley Software, LLC for claims relating to the Game will not exceed the greater of the amount you paid us through the Game during the 12 months before the claim or US $50.

These limits do not exclude liability that cannot lawfully be limited, and they do not reduce any mandatory consumer rights available where you live.

11. Responsibility for violations

To the extent permitted by law, you are responsible for losses and reasonable costs resulting from your unlawful use of the Game or a material violation of these Terms. This does not require you to cover losses caused by our own negligence, misconduct, or breach of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing a claim, you and East Valley Software agree to make a good-faith effort for 30 days to resolve it informally by contacting the other party. If it is not resolved, claims may be brought in a court with jurisdiction in Maricopa County, Arizona.

This section does not prevent either party from seeking urgent injunctive relief, bringing an eligible claim in small-claims court, or using rights or forums that applicable consumer law does not allow these Terms to restrict. These Terms do not require arbitration and do not waive participation in a class action where such a waiver would otherwise be available.

13. Changes, severability, and assignment

We may update these Terms to reflect changes to the Game, law, or our operations. We will post the updated Terms and effective date and will provide additional notice when required. Continued use after revised Terms take effect means you accept them; if you do not agree, stop using the Game.

If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization, merger, acquisition, or sale of assets.
